Hmm let hope there is sufficient evidence to secure a prosecution then, sounds like there is from reading the article. The maximum penalty which can be imposed with regard to illegally killing protected species under the WCA 81 is £5000 fine, 6 months imprisonment or both. To me the worry is, if he was ordered to do it then the instigator is still free to do the same again with another person.
The necessity of bird-watching is a really good reason for avoiding all forms of housework.

Yes, your quite right! Thankfully though under section 5 (1) it is an offence to knowingly cause or permit an illegal method of killing so if there is evidence the defendent was instructed to do this they also would be liable. This applies to offences such as laying poisoned baits out in the open, or setting traps illeaglly for example. However as seen in other cases this can sometimes still be very difficult to prove!
