Blue bird nest may be destroyed by new development

I am lucky enough to live in a flat where blue tits have decided to make a nest under the overflow pipe, I can hear the little chirps whilst in the toilet and I love it.

However this flat is part of some new development in the area and will be demolished.

Is it lawful for them to demolish the house with a blue tits nest in it?

I have no idea on these matters but I would hate for those horrible corporate builder people to destroy the blue tits home!!! Is there a way to register that they live there and therefore the area is protected? Or have I been watching too many crime dramas?

  • Hi Christina.

     

    Someone will probably be able to tell you much more than me but as I understand it, once a bird starts to build a nest it becomes fully protected by law (by the Wildlife and Countryside Act of 1981). This means that it cannot be intentionally removed, destroyed or blocked off.

    Therefore, the work will not be able to go ahead if you are aware of the birds nesting there and it is in fact illegal to do so. 

    It is protected until the nest is no longer in use and all the birds have left the nest.

     

    The RSPB will be able to help you with the particulars but I would contact the builder/landlord to inform them of the bird nest. This is a very important time for the eggs/chicks.
