My neighbour is having a new apex put on his house, under gutters/along gable end. He is aware there are birds nesting that will be displaced.
Is this legal, should I report this?
It is illegal so yes, you should report it to your wildlife crime officer.

John, I would suggest that before you jump in with both feet you check exactly what the neighbour is doing. After all you have to live there.
Section 2c of the Wildlife and Countryside Act says: A person shall not be guilty of an offence by reason of.... any act made unlawful by those provisions if he shows that the act was the incidental result of a lawful operation and could not reasonably have been avoided.
If he has planning permission and the building work was pre arranged and cannot reasonably be changed he might be able to use this defence.
