I work in a garden centre that often has a couple of robins trying to nest inside the shop. My employer has removed and encourages staff to remove the nests that are still being built. Any nests that have eggs in are always left. Is this legal? If not, should I do something about it?

No it is not legal, no difference between there being eggs or the start of a nest being built. Read the link that Wendy has sent, speak to, or print it out for your employer.

Schedule 1 birds can be disturbed under safety and health if there is no other way. Examples for nests in a tree. If a tree is a danger of falling on to someone’s house, or a road or railway lines and could cause death and there's no other safe way to deal with this problem. Those are some examples.

Is a Robin a schedule 1 bird?
No! It has going on for weeks about young birds in nests now for weeks. More than I can remember. So i keep banging on all birds in there nests and the majority should be left. Also many keep been concerned about other birds In General concerns in general. I don’t know why the large increase in recent months. It it is getting on nearly as much as the Osprey thread or threads that some about frequently on here and I often read those Osprey threads.

Sorry Wendy, I know about Robins, I was just asking Ian as he has once again posted stuff that is irrelevant to the conversation after you had already posted the relevant information. There was simply no need to mention Schedule 1 birds and complicate issues.

Exactly, Robins are not Schedule 1 so there was simply no reason for you to add that bit - especially since these threads are so common all you did by posting irrelevant material was bump it up again after the correct information had already been supplied.
