A field close to my home in South Devon has been identified as a possible site for housing under the Local Development Framework. I have heard and seen skylarks over the area for more than 10 years from as early as February onwards. I have not looked for nest sites. The skylark is fully protected under the WCA 1981. I want to know whether there is mileage in using this as a point against development of the land? The potential development is already opposed on other grounds, by those living close to the site.

Thanks Ian. Unfortunately I only thought about this as a possible objection after the deadline for representations had expired - it was hearing the skylark that made me think about it!
Our representation did make reference to the site being within an AONB so, hopefully, we may get chance to use this if necessary!

If making further representations on this matter, don't forget the Planning Authority's statutory obligation to have regard to the purpose of conserving biodiversity.
