I live on a new housing development with an area which was set aside for skylarks. Last week I noted that a landscaping company had been instructed by the developers to cut the grass in the public areas. I made them aware of the area for the skylarks, as I believed they were nesting and I also phoned and emailed the developer. Despite all my efforts they still cut the grass and upon checking the area, there appears to be evidence of damaged nests and worse adult and young birds. Can the developers be prosecuted for harming the birds and how can I prevent this from happening again? Thanks
I'm not a legal expert, nor a lawyer, so all I can do is share with you the link to the "Wildlife and Countryside Act 1981"
https://www.legislation.gov.uk/ukpga/1981/69
You could take it up with the RSPB Wildlife team by email via wildlife@rspb.org.uk or call on 01767 693690 (9:30-16:30, Monday to Friday),
or possibly even the RSPCA Telephone: 0300 123 4999
Another possibility might be your local council environmental dept.
