Skylarks

I live on a new housing development with an area which was set aside for skylarks.  Last week I noted that a landscaping company had been instructed by the developers to cut the grass in the public areas.  I made them aware of the area for the skylarks, as I believed they were nesting and I also phoned and emailed the developer.  Despite all my efforts they still cut the grass and upon checking the area, there appears to be evidence of damaged nests and worse adult and young birds.  Can the developers be prosecuted for harming the birds and how can I prevent this from happening again?  Thanks
