Have pushed the image as far as I can (or even more ;) ), and from the head patten it's definitely a falcon IMHO but further than that I could not say though Kestrel is best guess due to colouring.

It looks like a Kestrel fluffed up from the cold to me. But then my bird ID skills are still fairly shakey!
