This sounds like an attempt at baiting an angry response, but if you are serious and you have correctly identified the birds as Red Kites, and if you are in the UK, then 'getting rid' of them and their nest is illegal, as these are a protected Schedule 1 species. You risk a large fine or even jail time. But anyway, what's the issue? Red Kites are pretty innocuous birds, only a danger to worms, small mammals and road kill. Most people would be overjoyed to have them nesting in their garden.
I'm in Australia for starters the problem is I'm petrified of birds besides I never said I'd kill it just set my trees/whole yard on fire so it fucks off I am totally not overjoyed as far as I'm concerned it's trespassing on my property !!!
Oh and it's stealing and killing the neighbourhoods pet chickens!!
I can't comment on the law in Australia, and suggest this is the wrong forum to ask this question, the RSPB being a UK based charity organization. Wild animals don't 'trespass', as this only applies to humans. I say leave them be...
I think you would be best of asking locally what you should do - I don't think many of the forum members will have experience of Australian Kites - there seem to be a number of different ones all of which we would be thrilled to encounter. the P in RSPB stands for Protection so we aren't much use for you

All birds of prey are protected in all States and Territories of Australia, and it is therefore illegal to kill, injure, take from the wild, hold captive, trade or band any raptor without a permit issued by the relevant Government authority, or unless "special conditions" apply. In NSW, birds of prey are protected by the Biodiversity Conservation Act 2016 (BC Act).
I googled how to scare em off and this forum came up that's kinda weird
