Spotted in France in the Ardenne region, is this a black kite or a red kite?

I'm leaning towards black too because the tail doesn't look as forked as the kites I've seen but I'm far from 100%. My fingers are crossed it is indeed a black as it will be a first for me!
I am going to invite a correction but that tail does look very rufous to me in the 3rd photo. I am opting for red kite as the black kite should be overall darker. The light does come into play here and can make these birds appear lighter or darker.

This might not help but the first two photos are one bird and the third is probably a different bird. There were at least three kites around plus a couple of buzzards :)
Remembered a trick someone else did and lightened one of the close photos to see if that helps.
Black Kite for me, because of shallow tail fork and generally dullish colours. Black Kites aren't really so much darker than Reds as drabber, less contrasty with less bright tones (IMHO).

I have just run the third photo through Photoshop and the rufous tail that I thought I could see doesn't get any brighter however hard you try so I will now go with Black Kite as well.

Thank you all, really pleased to have seen one as it was the only new species I saw on the holiday!
I just remembered another thing - Black Kite normally shows six distinctly separated outer primary tips ('fingers'), Red Kite only five.
Yes forgotten about that point Aiki,the bird in question does seem to have a bit deeper notch in the tail than some Black Kites but it all helps keep us on our toes.
