GUESS: A can't answer as he has nothing to go on other than a brick wall, nor can B, C can only see B and D can see B and C. Im thinking it must be C as he know there is someone behind him and he can see the hat in front of him his white and the next black.

B because his hat is down over his eyes so by raising his eyes he can see the peak.
The necessity of bird-watching is a really good reason for avoiding all forms of housework.
The dust will still be there tomorrow - the birds may not be!

What do you mean 'and the next black'! C can only see the one hat. That said Kezmo you are almost there, very close to the whole answer.
Brenda H, Squirrel and Buzzard, It is not dark nor can the angle of a hat help and no jumping!, logic will solve this.
For viewing or photography right place right time is everything. I'd rather be in the right place with poor kit than have the best kit and be in the wrong place.
If Kezmo is nearly there with the answer, then it must be D.
A and B can't see anyone else, so are eliminated
C can only see B
D can see B and C and knows there is a sequence of two hat colours, so he knows his must be the next in the sequence.

There are two parts to the answer who? and why?. How does the one who knows, (after 20 seconds) know what colour their hat is, remember they can't guess. They must explain. Kezmo was not completely right but then not completely wrong!
Sorry if it makes heads hurt, sometimes if you don't see it instantly or as in this case after 20 seconds, it just gets harder. There is no trick just logic.
Perhaps you just need the desperation of wondering, (your life depends on it) why isn't D sure of the colour of his hat. He could save your life if he can see two hats of the same colour.
