Hi Lucy, I am not very sure as it is a picture from the back. I would guess at a bird of prey. It could be a Kestrel, Sparrowhawk, Peregrine Falcon. Where is the bird perched? Someone will know for sure once they see your post.

This bird has been in my garden all day and night even tho it’s a picture of the back of the bird do you have any ideas what bird this could be

Very good James, I found the two birdies but would not have known what they were. If you look at the snipe on the right and go down a wee bit, to 6 o clock, so to speak, is that another bird with its back to view, black with a white inderneath. You will need to enlarge the photo.
